1. Acceptance of Terms

By accessing or using the services provided by CAVU Pilot, LLC ("CAVU," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

CAVU provides credit financing solutions for flight training purposes. Our services include credit application processing, credit evaluation, loan origination, payment processing, and account management.

3. Eligibility

To apply for credit through CAVU, you must:

  • Be at least 18 years of age
  • Be a U.S. citizen or permanent resident
  • Have a valid Social Security Number
  • Be enrolled in or planning to enroll in an approved flight training program
  • Meet our credit and income requirements

4. Application Process

When you submit a credit application, you authorize CAVU to obtain your credit report and verify the information you provide. All information submitted must be accurate and complete. Providing false or misleading information may result in denial of your application and potential legal consequences.

5. Credit Terms

If approved, your specific credit terms including interest rate (APR), loan amount, monthly payment, and repayment term will be disclosed before you accept the credit offer. Interest rates are determined based on your creditworthiness and other factors.

6. Payment Obligations

By accepting a credit offer, you agree to:

  • Make all payments on time according to your payment schedule
  • Pay any applicable late fees for overdue payments
  • Notify us immediately of any changes to your contact or payment information
  • Repay the full outstanding balance plus accrued interest

7. Late Payments and Default

Failure to make timely payments may result in late fees, negative credit reporting, and collection activities. If your account becomes seriously delinquent, we may accelerate the full balance due and pursue legal remedies.

8. Electronic Communications

By using our services, you consent to receive electronic communications from us regarding your account, including statements, notices, disclosures, and other information. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

9. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

10. Limitation of Liability

To the maximum extent permitted by law, CAVU shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising from these terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the new terms.

14. Severability

If any provision of these Terms of Service is found to be unenforceable, the remaining provisions shall continue in full force and effect.
